Compliance Requirements
After obtaining your authority you will be subject to a 90 day
review. Be prepared "They Can Shut You Down!" (This
review goes towards your safety rating.)

1. Driver
Qualification:
- Employment
Application Should be Complete and Signed.
- Current MVR Check
Should be in File. (This needs to be rerun annually)
- Current DOT Physical
Should be in File.
2. Random
Controlled Substance Testing:
- All drivers must
have a DOT certified drug test before driving any commercial motor
vehicle.
- You need to join drug
consortium. (Remember to provide consortium with a current employee
list every time it changes i.e. someone quits or you have a new
hire.
- Files must be secure.
3. Log Auditing
- All logs and work
related documents must match. (Basically your receipts and bill of
ladings better match you logs) Log falsification is a serious
violation!
- All receipts must be
turned in by owner operators to company. Do Not forget
those maintenance receipts for your vehicle maintenance file!
4. Accidents
- A Register must be
kept of all DOT recordable accidents.
All documents pertaining to each accident must be in a file. This
means copies of logs, receipts for wrecker service, medical
attendance and documentation of phone calls.
5. Compliance Files
- Each Truck and
Trailer must have their own file with the VIN number and tire
size on the outside of each folder.
- Copies of every
receipt for repairs made on that particular piece of equipment must
be in the file.
- Most important
is the copy of the vehicles current annual DOT inspection.
6. Insurance
- You MUST
have a copy of your MCS90. This is the part of your insurance
policy. Call your Insurance agent, if you do not have a copy on
file.

Accident means—§390.5
Definitions.
(1) Except as
provided in paragraph (2) of this definition, an occurrence involving a
commercial motor vehicle operating on a highway in interstate or
intrastate commerce which results in:
(i) A
fatality;
(ii) Bodily injury to a person who, as
a result of the injury, immediately receives medical treatment away from
the scene of the accident; or
(iii) One or more motor vehicles
incurring disabling damage as a result of the accident,
requiring the motor vehicles to be
transported away from the scene by a tow truck or other motor vehicle.
(2) The term accident does not
include:
(i) An
occurrence involving only boarding and alighting from a stationary motor
vehicle; or
(ii) An occurrence involving only the
loading or unloading of cargo.
